Supreme Court Seeks Reply from Haryana Government and Mahira Buildwell in EWS Housing Case

The Supreme Court has sought detailed responses from the Haryana government and a real estate developer over alleged irregularities in an Economically Weaker Section (EWS) housing project in Gurugram. The matter was taken up after a homebuyers’ association accused the developer of serious violations under an affordable housing scheme.

The petitioners have alleged that the builder obtained project approvals through questionable means, including the use of forged documents and bank guarantees. It has been claimed that despite collecting substantial amounts from buyers, only a small portion of the construction work has been completed so far.

According to the association, homebuyers invested their savings in the project under the Pradhan Mantri Awas Yojana (Urban) framework, expecting timely delivery of homes. However, delays, incomplete construction, and alleged misuse of funds have caused significant financial and mental distress to the affected families.

The Supreme Court bench also observed that lapses in regulatory oversight may have contributed to the situation. The petition highlighted alleged failures on the part of authorities to carry out proper due diligence while granting approvals and monitoring project progress.

In addition to the state government and the developer, the court has sought responses from regulatory and financial institutions linked to the project, including housing regulators and banks. The petitioners have argued that weak enforcement of statutory norms enabled the alleged wrongdoing.

The court noted that it is already examining several cases involving housing projects where buyers were adversely affected due to irregularities in subvention schemes and project approvals. Investigations in similar cases have earlier led to multiple FIRs against builders across states.

The matter remains under judicial consideration, and the apex court is expected to review responses from all concerned parties before deciding on further action.
